retaliate. a triple shooting that killed one man and wounded two women. it happened just before 11:00 last night on yorkshire drive not far from deer valley road in antioch. two of the victims are a mother and adult daughter and that the two had a restraining order against the alleged gunman. that gunman was pronounced dead at the scene. police say he had a gunshot wound to the head. neighbors in the area say the violence is shocking. >> we said what is this? to hear about somebody being shot, it -- it's devastating. >> the two women were taken to john meir medical center where they are in stable condition this morning. investigators in the south bay are looking to identify a body found burning near busy south bay on-ramp. the victim was found at a roadside encampment along the cottle road on-ramp to northbound 85 not far from

kaiser hospital. that is where "today in the bay's" bob redell joins us live with more on this gruesome discovery. good morning, bob. >> reporter: good morning, laura. chp and fire not only trying to figure out who that perch was but what started this fire in the stand of trees. several drivers called 911 a little after 9:00 last night to report that the brush and trees were on fire. as the fire department was putting it out they made the discovery of this badly burned body. it appears he or she -- again, they couldn't determine the sex, but it appears that this person was homeless, based on a mattress and tent found nearby. the fire department doesn't believe there was foul play involved but they're not yet 100% certain. >> at this particular time, that's unknown. we're trying to determine whether it's accidental or purposeful. at this particular point in time nothing says it's anything other than an accidental fire. >> reporter: this on-ramp was

shut down for a period of time last night. it's now reopened. this should have no impact on your morning commute. reporting live in south san jose, bob redell, "today in the bay." expecting new details on exactly what caused dozens of bolts to break on the eastern span of the bay bridge. "today in the bay's" christie smith joining us live on treasure island with a look at this inspection. good morning. >> good morning, john. this is not what anyone expected to hear about a bridge being built specifically for seismic safety, that a number of bolts had snapped just days after being installed. caltr caltrans is expected to talk more about what went wrong but also talk about a number of possible solutions at a recent meeting with the metropolitan transportation commission in oakland. engineers discussed fabricating a sleeve for the bridge. the bolts we're talking about are about nine to 24-feet long and caltrans believes there was hydrogen in the process of making them and that turned the steel brittle.

because of their size and location, simply replacing them, though, won't come easy. they're not easy to get out. again, it relates to the access issue. they actually have to be extracted as far as you can pull them out. then you have to cut a piece off. >> reporter: the chronicle is reporting that a second batch of 192 bolts on the new eastern span of the bay bridge has been tightened into place and so far they are holding. no signs of cracks or stress. reporting live on treasure island, christie smith, "today in the bay." >> christie, thank you very much. beautiful shot behind the bridge. >> did you see the sunrise out there this morning, looking for a beautiful bay area morning. hope you get a chance to enjoy it. take a look at that. pretty warm temperatures. right, christina? >> oh, yeah, laura and jon. with all this sunshine coming in so early, it's an indication of a warm day ahead. temperatures this morning are already at seasonal averages in places like oakland, starting the day at 6:06 this morning,

typically coldest point of the day, right around sunrise here at 63 degrees. 57 in sunnyvale, 48 degrees to start in gilroy. let's talk about what we're expecting for today. it will be the warmest day of the year so far, 5 to 10 degree spikes from yesterday's highs and fog and drizzle on the way tomorrow leads to significant cooling. so you're only going to get one day of temps in the upper 80s, low 90s. into the weekend temperatures will level off and we'll see the 70s. it will be perfection. one of the spring weekends. make those outdoor plans if you're staying here around the bay area. because this is the only day, as we said, 86 degrees inland. 80 at the bay and 74 at the coast. we'll take you live to tahoe. that's coming up next. check your drive. good morning, mike. >> good morning. we're going to start off with this view of mission boulevard at 880. that transition is okay. you see the traffic volume picking up. that's my concern. let me take you to the map.

we're track iing a sigalert for 680 at mission boulevard. the south of mission boulevard. off-ramp. the connector between 680 and 880, two major interstates there through the area. and that is closed right now, getting over as you're traveling north out of milpitas into fremont. alternate is auto mall parkway. they'll have that off-ramp closed until close to 7:00. i hope to announce the reopening before the end of this show. we look at the slowing in both 880 and 680 in the area, the volume is starting to build. ooh, a live picture, it looks like. is this the big rig, you guys? i'm assuming this is the big rig at the off-ramp there on its side. i don't think we have any others in the bay area. that's what they have to right and clear from the off-ramp before they can clear it. there you go. south bay, smooth drive here, northbound 101. slows there. and construction 880 at steven's creek boulevard in the middle of the screen. as you come over the santa cruz mountains, two issues. first one is here on highway 17, right under the bridge at santa

cruz. we do have a stalled vehicle. folks are swerving around it, it's sticking out in the slow lane. stay over to the center divide and go slowly in the area. other folks are hitting the brakes causing that ripple effect through the area. the other issue is overnight we had a deadly crash, bear creek road at highway 35, down the embankment, off the roadway. crews are there. the investigation has cleared. they have to remove that car in the morning hours after the sunrise. so that may be an issue for locals. meanwhile, highway 17 continues to build southbound for slowing over the summit. live lock outside. we'll show you how things are. backup quickly forms after 6:00. typical pattern here approaching on a wednesday, guys. back to you. >> beautiful sunrise once again. >> oh, yes. feels good just to see it. wedding bouquet backlash. sounds like an exciting episode on a reality show. how flack over a facebook post is getting a washington florist sued by the state. governor brown signs a trade

anti-gay stance with a look at how california could force a group to pay now for a ban that could be repealed later. good morning. >> laura, good morning. next month the boy scouts of america is expected to finally make its decision on whether to allow gay members and leaders into the organization. so, there's your potential repeal. but one southern california senator does not have the patience for this, so he is introducing what's called the youth equality act. today, lawmakers will consider it for the first time. democrat riccardo laura's bill would include taxes for an organization, boy scouts and its california affiliates would have to pay corporate taxes on donations, membership dues, camp fees and other sources of income. the senator outright admits his bill is intended to pressure the scouts to lift its anti-gay

policy. the openly gay scout for moraga, denied the rank of eagle scout even though he completed all his requirements. it is safe to say he and his family are going to support this new bill. as for how it's going to play out in sacramento, one legal analyst aren't sure that moderates will jump on board tax increases that target organizations base on ideology alone. however, some affiliates are already being treated a little differently because of it. i'll explain how in my next report. jon? >> looking forward to it. in washington state a florist facing flack. now a lawsuit this morning after refusing to provide wedding flowers to a gay couple for their wedding. attorney general in washington suing the owner of arlene's flower flowers, saying she violated the state's anti-discrimination

laws, the first of its kind since voters legalized same-sex marriage last november. in a facebook post, the florist said she had a gay customer who had been in many times to buy flowers but when it came time to do his wedding she said she could not do it because of her christian beliefs. she says he thanked her and respected her opinion. in a facebook post of his own, that customer says he has a heavy heart over what happened, but he says he is heartened by this lawsuit. 6:14. time for a quick check of the day's other top stories. france has moved toward legalizing same-sex marriage, passing part of the bill. two parents accused of kidnapping their children and fleeing to cuba are back in the u.s. joshua and sharyn hakken took the 2 and 4-year-old from their grandparents. they are now back safe at home.

wikileaks, fighting prosecutor's plans to call a witness who took part in the raid that killed osama bin laden. prosecutors say the witness would testify bin laden had digital copies of documents bradley manning admits he leaked. 6:15 right now. new this morning, governor jerry brown signing a trade deal of sort with his china. >> scott mcgrew joins us. the governor is limited on what sort of deals he can actually make. >> yes, that's true. states can't make their own independent deals with sovereign nations. brown, who is in china to push for better trade with california as best he can, was able to hammer out some sort of deal. california and china signed a deal to create a task force to find the best ways to boost trade and investment. now, china already hugely important to california. a third of all chinese exports to the u.s. either end up here or pass through california ports. and more than a third of all chinese educated in the united states are educated at a handful

of california universities. the dow industrials hit another record tuesday. we're back to records after sort of sideways trading over the last few weeks. except the nikkei. money has been pouring into that market for reasons we discussed previously. here at home, jcpenney fell 12% following the ceo switcheroo. general motors will once again advertise on facebook. this is news mostly because of the strange way gm pulled its ad s from the social networks hours, just hours before facebook's big ipo. we never really did figure out why, but it goes down in business history as one of the worst slaps in the face ever. directv users, you may soon have an option for a new premium channel called dog tv, 24 hours of programming every day for dogs, featuring dogs. we showed you the slopy dog segment. here is the active dog segment. the idea is you tune in to dog tv before leaving home. it gives your puppy something to

the upper 40s. you could probably go straight to a long sleeve shirt or short sleeve if you're a tough guy, because it's going to be warm today. marine layer will stay way out to sea for us today. and temperatures are going to warm nicely. look at these numbers, 90 degrees for fairfield today. 85 in napa. down south in gilroy, warmest city in the south bay, close to 90 degrees. 87 for you today. temperatures will drop right back off. onshore flow picking back up. fog and drizzle in the morning. that will lead to a really cool afternoon, though, with that nice, cool ocean air pumping in all day long. it's going to drop our temperatures by 10 to 12 degrees. this warm-up is short lived. i.e., get it while it's warm. saturday to sunday, temperatures stay steady. in the upper 60s and low 70s all weekend long. monday into tuesday, things start to change a little bit. area of low pressure riding to our north. temperatures will fall into the mid 60s. by tuesday, stable atmosphere, climbing back up to the mid 70s.

things starting to get a little more toward the norms this time of year. let's check your drive and see how normal it is this morning with mike inouye. >> well, that's not normal for the big rig. can you pick this up, please? i feel like i'm at my house. over on its side. photogra photographer allen has the shot here. see a little kitty litter sprinkled over here? looks like there's oil or gasoline leaked here. it didn't get into the soil, that would be another issue. the driver was apparently able to get over there, on the passenger side, stand up and get out of the vehicle. there you go. we have to re move this. that's why they've closed that off-ramp from north 680. let me show you this on the maps. why it's a big deal. north 680 out of milpitas and into fremont. 680, and connector between 680 and 880. fremont funnel, because these two freeways funnel over into

that small connector, making things very difficult in the morning. worse now because of that big rig, box truck on its side. auto mall parkway is your alternate or d uchurham. connect toward auto mall passing. and smooth drive in both directi directions on the thoroughfares. that should be okay for you as the commute continues to build. we expect that route to reopen just about 7:00. we'll track that from chp. they haven't given us much update because they're still waiting for the crews to remove that truck. 58 0, typical build out of the altamont pass. no big surprises for the tri-valley. tough monday and tuesday this week. castro valley y and 880 starting to show building. minor slowing. typical pattern through heyward and across the san mateo bridge. further live look across oakland coliseum. northbound side, slowing past high street. it's wednesday break we typically get after traffic. tuesday, that's what we see. metering lights are, indeed, on over at the toll plaza.

we have a follow-up this morning to a big-time decision in the south bay. last night, santa clara city council clearing the way for a massive shopping center near the brand new 49ers stadium. council members approving a plan to close a bmx track and an 18-hole golf course and tennis club to make way for a new entertainment district filled with shops, restaurants and housing. that complex is expected to be five times the size of san jose's santana row.

thanks for joining us. i'm jon kelley. >> and i'm laura garcia-cannon. streets near the white house shut down earlier today as the secret service investigates a suspicious vehicle. the secret service says the vehicle was found park ed near the white house, but so far it's unclear exactly why the vehicle is considered suspicious. streets near the white house have now been reopened. meantime, washington, d.c. getting all ready for a huge immigration rally this morning. groups from all around the country coming together today to push for comprehensive immigration reform. "today in the bay's" tracie potts is live where today's rally is being held. tracie, good morning. >> reporter: good morning. this afternoon, we are expecting thousands of people here. take a look behind me. this is the national mall, the area where organizers say they expect maybe even tens of thousands of people from all over the country. we hear there are going to be 400 buses dropping people off here for this immigration rally, taking a live look now at the

mall where this rally is going to get under way later this afternoon. the aim? to push lawmakers this time to get something done. what we're hearing is some of the last major stumbling blocks is something that may have been worked out this morning from senator dianne feinstein that farm workers and growers have worked out one of the last snags they were at odds over wages, making sure people who have been in this country, working, living for years. but illegally can now say a path to citizenship. 1.7 million part of the group's numbers u.s.a. who say they toent want to rush this. they want to make sure that those people who may be eligible for visas or perhaps citizenship end up at the back of the line. where is congress standing on all of this? we are expecting the group of eight that's been working on

this, democrats and republicans working on this may have legislation ready to read as early as tomorrow, but more likely early next week. >> very busy day out there, tracie potts. thank you very much. among those descending on the nation's capital today, dozens of high school and middle school students from right here in the bay area. our cameras are with them as the fwroop left oakland international airport yesterday. the students say they fully support citizenship rights for all undocumented workers and the passage of the federal dream act. >> fortunately, i was born here. i don't think it's fair for people who are trying to come over here, trying to have a better life. they can't do it. >> organizers tell us most of those students actually raised their own money for the trip, asking for donations door to door and speaking to unions. so, some active youngsters out there, making things happen. 6:33 right now. we've been admiring the beautiful sunrise out there this morning. >> indeed, we have.

>> checking current conditions with christina loren. >> good morning, jon and laura. this, of course, the san francisco bay. bay bridge here off in the distance. a beautiful day shape iing up. it will be really nice. too warm for some people's comfort as they head throughout the second half of the day. starting off really mild. in san francisco, you're at 57 degrees. 47 in gilroy a. starting the day, yesterday was a bit on the toasty side. we head through your thursday, am fog and drizzle. onshore flow leads to significant cooling. one day only in the temps in the 90s. as we head into your weekend looks good for swrout door plans, temperatures in the 7 0s. if you want to take your kids out to tahoe, great skiing conditions and we'll hold on to great beach conditions as well. seven-day forecast is in my next report. 74 grease at the coast, 80 at the bay and 86 inland.

that doesn't look like the drive people want for the morning. >> no. the tow truck is in the right position, the box truck is not. it's getting bright out there. we'll have to add just this shot. backing the tow up there. worry hoping to get this cleared before 7:00. they did just hook up the cables. you see that big rig tow truck backing up. they'll try to get perpendicular to this truck and basically pop it right back up on to its wheels. see how it goes. it doesn't look like there's any structural damage to the rig. this is closing the off-ramp from north 680 on to mission boulevard. no cutoff between 680 northbound and heading over toward 880 itself. that's a major issue. southbound is the commute direction. there's slowing around that interchange. know to completely stay clear even out of the tri-valley, use the auto mall parkway connector, taking you via durham over toward 880. no slow iing on that approach o of sunol. smooth, easy alternate for you to try this morning if you haven't done it before. pretty big roadway and good

connector there. take you off to the maps south bay. northbound routes are starting to slowdown. 87 into downtown and 85, just showing that slowdown. heading up highway 17. check of the bay bridge toll plaza as well as the metering lights are on. street lights have turned off. backup a little bit lighter than normal. it's pretty instead, though, all the way back past west grand avenue. back to you. >> thank you, mike. 6:35. santa clara soldier who died will be laid to rest next to his father. 24-year-old specialist delfin santos jr. was killed with two american soldiers over the weekend. suspected car bomb exploded while they were delivering textbooks to school children. sant toes' father fought against the japanese during world war ii, held as a prisoner of war. santos jr. was the youngest of 17 children. he and his sister, madeline,

we are happy to report a 10-month-old puppy gets a second chance at life after being tied up on train tracks. the operator of that oncoming train saw the puppy out on the tracks, managed to stop the train just in time. officials say they will not be pursuing animal cruelty charges against that elderly man because he appeared confused and really didn't understand what he had done. now the puppy's nickname is banjo and banjo is now safe and up for adoption. extra security is now in

welcome back, everyone. 6:44. we are expecting new details on what caltrans plans to do about those broken bolts on the new span of the bay bridge. dozens of the steel rods snapped after being tightened last month. meeting later this morning. christ christie? >> in a couple of hours, caltrans is expected to talk about a number of options they're looking at to try to fix this problem. this came as a huge surprise that about a third of the 96 bolts installed on the seismic safety structure of the eastern span of the bay bridge snapped after being tightened. recently, engineers talked about creating a collar to help hold it in place. that was one of the options they discussed at a meeting in oakland. engineers have said there really is no excuse for the steel rods to break, that it was preventable. caltrans believes the bolts had hytrogen in them, which made the steel brittle. second batch of bolts has been tightened and holding up so far, made by the same ohio company that made the original bolts. the new ones were apparently made two years later. they still want details on what exactly happened here, how to fix it. caltrans is expected to be talking about that at 9:30 this

the victims are a mother and adult daughter, and the two had a restrain iing order against t gunman. police say the gunman had a gunshot wound to the head. the two women are in the hospital in stable condition. busy on-ramp burning, victim was found at a roadside encampment at the cottle road on-ramp to 85. bob redell joins us live with more details on the gruesome discovery. bob? >> reporter: good morning to you, laura. chp and san jose fire department are trying to figure out who this person was that was living among these trees northbound highway 85 and trying to figure out what start this had fire that killed him or her. several drivers called 911 a little bit after 9:00 last night to report these brush and tres s right here along the highway were on fire. as the fire department was putting it out, they discovered the badly burned body. it appears, the fire department

says, he or she was homeless. you can see why, based on the fact they found that mattress there and other camping materials. the fire department doesn't believe there was foul play but they're not yet 100% certain. >> what we found were some things, things like a mattress, tent and things like that. it did appear that the person did reside in the area where we found the body. >> reporter: the on-ramp was shut down for a short time last night. it is now reopened. this should not have any impact on the morning commute because it is reopened. again, they're not exactly sure of the cause. they don't believe that there was foul play. right now they're leaning toward this being an accident. as i mentioned they're not 100% certain until the investigation answers that question for them. reporting live here in san jose, bob redell, "today in the bay." mother and father accused of killing their daughter's suspected pump will be formally charged with first-degree murder later on this morning.

prosecutors say barry gilton and lupe mocato plotted to kill sneed last summer. they and two other men killed sneed after they were tipped off to his whereabouts. all of those accused in the killing could enter their pleas this morning. boy scouts of america is expected to make a decision on whether to overturn their ban on allowing gays into their organization. a senator in california wants the organization to pay for their ban. >> reporter: in a roundabout way. out of long beach, wants california boy scout affiliates to start paying taxes. today, he is officially introducing the youth equality act. the bill would deny tax exempt status to nonprofit youth groups that discriminate on the basis of gender identity, race, sexual orientation, nationality, religion or religious affiliation. this means the boy scouts and

its california affiliates would have to pay corporate taxes on donations, membership dues, camp fees and other sources of income. the senator says, quote, our state values the important role that youth groups play in the empowerment of our next generation. this is demonstrated by rewarding organizations with the tax exemptions supported financially by all californians. sb323 seeks to end the unfortunate discrimatory and outdated practices by organizations. end quote. however, some california cities are already punishing local troops by withdrawing their free rent, making them pay like everyone else. the bill will be heard in its first committee hearing in sacramento today. of course, it is a story we'll continue to watch for you. jon?

>> marla, thank you very much. san jose appealing a ruling, making city officials private texts and e-mails public record. the ruling coming from a lawsuit by south bay activist who sued the city for refusing to disclose personal electronic communications from mayor chuck reed and other city leaders regarding a development project. that ruling marks one of the first times a california court has tackled the state's public records law when it comes to communications through smart phones and social networks. san jose city attorney says the ruling raises serious questions about privacy. >> 6:53. a step forward today in california's plan to use cyber courses as a way to deal with overcrowding of public universities. lieutenant governor gavin newsom will appear to announce the expansion of on dline courses offered to students at csu campuses. first campus to launch the pilot program, offering entry-level online courses for college credit.

the president of the university says the success rate for math and algebra courses are similar to those seen in other courses. right now scott mcgrew continues our coverage. as you point out, online classes are particularly helpful to struggling students. >> that's right. it's the aspect we haven't talked about a lot, the push for online corpses in california. many school students are showing up to san jose state -- i beg your pardon on my ipad. high school seniors turning college freshman aren't show in up, prepared for college. many of the deals clemgs are making like san jose state, this one with udacity, designed to shore up undereducated students. underfunding of state universities, some classes so full that students have to spend more time in college waiting for the proper classes to graduate. online classes help solve that shortage. we have seen our first dangerous mistake in the face-off between the two koreas.

according to sources close to negotiations, two key senators and their staff worked late into the night hammering out the final details of a compromise on background checks. they will roll out their plan at a news conference which will begin in just about an hour. democratic senator joe manchin of west virginia and republican senator pat toomey of pennsylvania are stoat announce a deal on background checks today. sources close to the negotiation say the deal would require background checks on most commercial gun sales including purchases made at gun shows and over the internet but would exempt checks for most person-to-person transactions. for example, a gun could be given as a gift between relatives. >> this is a tough, tough fight. if you look at the history of gun control legislation over the last 100 years, it hasn't happened very often at the federal level. >> reporter: the deal is far less than the president was hoping far but could be mr. obama's best chance for enacting new gun laws in the wake of the newtown tragedy.
